What is an Employee?

In construction, an employee is a person hired directly by a construction company, general contractor, or subcontractor to perform specific tasks or roles on a project site under the direct supervision and control of the employer. Unlike independent contractors or subcontractors who work under separate agreements, employees work under an employment relationship where the company controls how, when, and where the work is performed. 

Construction employees are distinguished from other site personnel by their direct employment status, which creates specific legal obligations for both the worker and employer. Construction employees must meet specific requirements and fulfill various responsibilities throughout their employment. All workers must complete safety training programs and maintain current certifications relevant to their roles. 

Key employee obligations include: 

  • Reporting to work on time and maintaining accurate time records 
  • Using personal protective equipment (PPE) as required 
  • Participating in regular safety meetings and training sessions 
  • Reporting hazards, incidents, and near-misses immediately 

Legal and Regulatory Considerations

Construction employers must comply with numerous federal and state regulations governing employee rights, safety, and working conditions.
